THIS PRIVACY NOTICE SUPPLEMENTS OUR PRIVACY POLICY AND FOR SUBSCRIBERS AND/OR INVESTORS IN THE CALVERA INCOME AND GROWTH FUND, APPLIES TO YOU AND IS INCORPORATED INTO AND FORMS A PART OF YOUR AGREEMENT WITH US. READ THIS CAREFULLY BECAUSE IF YOU DO NOT OR CANNOT AGREE TO EVERYTHING WRITTEN HERE YOU SHOULD NOT SUBSCRIBE OR INVEST AND WE ENCOURAGE YOU TO CONTACT US IF YOU HAVE ANY CONCERNS AT ALL REGARDING THESE TERMS AND CONDITIONS. TERMS USED IN THIS PRIVACY NOTICE HAVE THE SAME MEANING AS DEFINED IN OUR TERM OF USE AND PRIVACY POLICY.

BY SUBSCRIBING OR INVESTING, YOU ARE CONSENTING TO OUR DISCLOSURE OF CERTAIN PERSONAL INFORMATION, AS DETAILED BELOW, TO NON-AFFILIATED THIRD PARTIES. What You Should Know 

We recognize the importance of keeping information about you secure and confidential.  We do not sell or share your personal information with marketers or others outside our affiliated group of companies. 

We carefully manage personal information among our affiliated group of companies to safeguard your privacy and to provide you with consistently excellent service. 

We are providing this notice to you to satisfy a federal law that requires investment funds to inform their clients of the policies regarding the privacy of investor information, including your personal information. 

Our Privacy Policy 

We are committed to protecting the personal information of our investors and former investors.  We fulfill our commitment by establishing and implementing policies and systems to protect the security and confidentiality of this information. 

We limit access to personal information about you to those personnel who need to know the information in order to provide products or services to you.  We maintain physical, electronic and procedural safeguards to protect your non-public personal information. 

Categories of Information We Collect 

We may collect the following types of personal information about you from the following sources: 

  • Your name, address and identifying numbers, and other personal and financial information on applications, subscription agreements or other forms or communications. 
  • Information about your account balances and financial transactions with us, our affiliated entities, or non-affiliated third parties, from our internal sources, from affiliated entities and from non-affiliated third parties. 
  • Information about your account balances and financial transactions and other personal and financial information, from consumer credit reporting agencies or other non-affiliated third parties, to verify information received from you or others. 

Categories of Information We Disclose to Non-Affiliated Third Parties 

We may disclose your name, address and account and other identifying numbers, as well as information about your pending or past transactions and other personal information, to non-affiliated third parties as necessary to administer and service the fund in which you are invested, as well as to facilitate transactions being entered into by such fund.  Consistent with industry practice and the provisions of our fund agreements or in accordance with applicable law we may distribute certain personally-identifiable financial information such as the schedule of investors to the fund agreement and their respective ownership percentages, to all investors in each specific fund, as well as to potential lenders or other parties to potential transactions involving the fund in which you are invested. 

We may disclose personal information concerning you to law enforcement agencies, federal regulatory agencies, self-regulatory organizations or other non-affiliated third parties, if required or requested to do so by a court order, judicial subpoena or regulatory inquiry. 

Other than as otherwise described in our general Privacy Policy, including with respect to Service Providers (as described therein), we do not otherwise disclose your personal information to non-affiliated third parties, except where we believe in good faith that disclosure is required or specifically authorized by law. 

Categories of Information We Disclose to Our Affiliated Entities 

We may disclose your name, address and account and other identifying numbers, account balances, information about your pending or past transactions and other personal information to our affiliated entities for any purpose. 

We regularly disclose your name, address and account and other identifying numbers, account balances and information about your pending or past transactions to our affiliates to administer and service the fund in which you are invested. 

Information about Our Former Customers 

We do not disclose personal information about former customers to non-affiliated third parties unless required or requested to do so by a court order, judicial subpoena or regulatory inquiry, or otherwise where we believe in good faith that disclosure is required or specifically authorized by law. 

We will provide you with a copy of our Privacy Notice annually, as long as you maintain an investment with us.  This terms and conditions of any Privacy Notice may change from time to time, but you can always review our current policy by contacting us for a copy.
